Guaran tee and Compensation
Barco provides a guarante e relating to perfect man ufac turing as part of the legally stipulate d terms of gua rantee. On receipt, the pu rchaser
mu st immediatel y insp ect all delivered goods for damage incurred during transport, as well a s for material and manufacturing faults Barc o
must be informed immediately in writing of any c omplaints.
The period of guarantee begins on the date of t ransfer of risks, in the case of special systems and software on the date of c omm issioning,
at latest 30 days after the transfer of risks. In the event of justified notice of com plaint, Barc o can r epair the fault or p ro vide a replacement
at its own disc retion within an appropriate period. If this m easure proves to be impossible or unsuccessful, the purchaser can demand a
reduc tion i n the purchase price or cancellation of the contract. All o ther claims, in parti cular those relating to compensation for direct or
indire ct damage, and also damage at tributed to the operation of s oftware as well as to other services provided by Barco, being a component
of the system or ind ependent service, will be de emed invalid provided the dam age is n ot p ro ven to be attributed to the absence of pro perties
guara nteed in writing or due to the intent or gross negligen ce o r p art of Barc o.
If the purchaser or a third party carrie s out modifications or repa irs o n goods delivered by Barco, or if the g oods are handled incorrectly,
in particular if the systems are commissioned operated incorrectly or if, after the transfer of risks, the goods are subject to influences not
agreed upon in the contract, all guarantee claims of the purchaser will be rendered invalid. Not included in the guarantee coverage are
system failures which are attributed to programs or special electronic c ircuitry provided by the pu rchaser, e.g. inte rfaces. Nor mal wear as
well as norma l maintenance a re not subject to the guara ntee provided by Barco either.
The environmental conditions as well as the servi cing and mainten ance regulations specified in the this manual must be complied with by
the customer.
